MyHealthNewEngland User Agreement

Between  

Health New England, Inc. and 

HNE Member  

Read this agreement carefully.   

Use of the Health New England, Inc. (“HNE”) MyHealthNewEngland web site (the “Site”) is subject to the terms and conditions set forth below. If you do not agree to these terms and conditions, you may not access the Site or use the services provided through the Site.  

Please see important information about electronic delivery of Explanations of Benefits and other member communication from HNE in Section V, below. 

This Agreement is between you (the “User”) and HNE. HNE may terminate this

Agreement and your right to access the Site at any time, without cause and without prior notice.   

In consideration for accessing and using the Site, the User and HNE agree as follows: 

I. By accepting the terms of this Agreement, the User may elect to opt-in to receive electronic copies of member materials. Paper copies of all electronic member materials are available upon request.  

II. You represent that you have properly identified yourself by entering your own name and personal identifiers when registering for this site and not those of any other person. 

III. The Site is intended for users eighteen (18) years of age or older. Any registration by a person under eighteen (18) years of age is prohibited. By accessing and using the Site, the User represents and warrants that he or she is eighteen (18) years of age or older. 

IV. The User’s use of the Site shall be for personal, non-commercial use only. 

V. The User shall:  

1. Review HNE’s Privacy Policy prior to accessing the Site. 

2. Be solely responsible for all activity on, and transactions through, the Site that are attributable to the User’s password. ( To ensure your privacy, never share your username and password with anyone unless you want them to have access to your personal data.) 

3. Use the information from the Site for his or her personal use only. The User may not reproduce or distribute the text or graphics to others, or substantially copy the information to his or her server, or link to the Site, without HNE’s prior written permission.

4. Keep information that he or she obtains from the Site, including, but not limited to, information about HNE’s business practices, providers, or rates of payment to providers, confidential.  

5. Not use the Site for any fraudulent purpose or in a manner that would violate any state or federal law.

6. Not attempt to gain access to any other individual’s information, except as allowed by HNE.

7. Not hold HNE liable for any risk or damage, whether actual or threatened, due to the User’s use of the Site.

8. Notify HNE when the User’s email address changes. 

VI. By agreeing to the terms of this Agreement, the User is agreeing to receive Explanations of Benefit (“EOBs”) and other communication from HNE via the User’s MyHealthNewEngland account. The User further agrees to receive notice of new postings to the MyHealthNewEngland account via the User’s registered email account. The User acknowledges that he or she is electing not to receive paper versions of EOBs and other communication from HNE.  At any time, User may opt out of receiving EOBs and other communication from HNE via the User’s MyHealthNewEngland account by changing his or her user preferences.

Notwithstanding the foregoing, the User may request at any time a paper version of any electronically furnished document at no charge to the User. 

VII. The User shall indemnify and hold HNE harmless for all risk of, or damage resulting from, the User’s use of the Site. HNE DOES NOT MAKE ANY

WARRANTIES WHATSOEVER, EITHER EXPRESS OR IMPLIED,

INCLUDING, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF

MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, WITH

REGARD TO THIS SERVICE, OR ANY INFORMATION PROVIDED ON

THE SITE, AND WILL NOT BE LIABLE FOR ANY COST OR DAMAGE

ARISING EITHER DIRECTLY OR INDIRECTLY FROM THE USER’S USE

OF THE SITE. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL

THEORY, TORT, CONTRACT, OR OTHERWISE, WILL HNE BE LIABLE

TO THE USER OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL,

INCIDENTAL, OR CONSEQUENTIAL DAMAGES OR LOSSES OF ANY NATURE WHATSOEVER WITH REGARD TO THE USER’S USE OF THE

SITE. 

VIII. All data received by HNE via the Site is treated as confidential, and HNE will not disclose any identifiable data to third parties.   The User can give others permission to access claim details by granting access through the member preferences section of the site.

IX. HNE does not warrant the accuracy, completeness, timeliness, or usefulness of any information provided on the Site. Nor does HNE warrant that the Site will be free of all errors or that the use of the Site will be uninterrupted.  

X. This Agreement and related policies may be updated at any time without prior written notice. The User shall be responsible for reviewing this Agreement from time-to-time for updates.

XI. This Agreement is to be governed and construed in accordance with the laws of the Commonwealth of Massachusetts without regard to any conflict of law provisions.
